Event conditions of entry

Please note that the conditions of entry have recently been updated.

Because of the unique nature of this event, the following terms and conditions of entry will apply. All entrants must sign the entry form and agree to abide by these conditions before an entry will be accepted.

Special Note

Please be sure to attach your full runner bib number to the FRONT of your body - not your back or on a bag. Officials must be able to see it easily and quickly. Please note that you may be stopped and asked to stand to one side while other runners are checked if your number requires extra attention.

General conditions

These general conditions of entry must be read by all entrants. It is mandatory to read these before proceeding to the entry and registration area.

Hereafter the Organising Committee means the committee appointed under clause 9.1 of the Kepler Challenge Mountain Run Trust Deed, dated 19 November 1998 and varied by Deed dated 17 October 2007, for the purpose of organising and running the Kepler Challenge Mountain Run and Luxmore Grunt Mountain Run.

  1. All online entries must be accompanied by an email address and compulsory details as laid out in the entry form.
  2. The Organising Committee reserves the right, at their absolute discretion, to refuse entry to individuals whom they deem to be not capable of safely completing the event.
  3. As part of our safety requirements, entrants must attend the safety briefing held the evening before the event.
  4. Any entrant who suffers from a medical condition (allergy etc) that could affect their safety, should consult with their doctor before entering, and provide full details in the Medical Section. (Note: Medical certificate may be required.)
  5. Competitors must carry sufficient storm gear to cover all possible weather conditions as outlined in the Compulsory Gear list. This gear will be checked by race officials at registration and before race numbers are issued. This gear must be carried or worn by all competitors for the duration of the event. Kepler Challenge competitors will be re-checked at Luxmore Hut. Spot checks of gear will also be made at the finish line. Competitors who do not carry the compulsory gear will be disqualified and withdrawn from the event.
  6. All entrants must fill in the Profile with details of their training preparation and previous experience as well as other sections of the entry form as required. Inadequate details will delay acceptance of entries or may invalidate your entry.
  7. Participants who encounter a fellow participant who is injured or in serious difficulty are obliged to provide help and/or support until event officials are notified and suitable assistance is available.
  8. The Organising Committee reserves the right to withdraw competitors from the event at any time.
  9. Competitors who withdraw themselves from the event may be liable for transport costs to remove them from the track. A helicopter service may be available (weather permitting).
  10. Kepler Challenge competitors who fail to reach Moturau Hut in 9 hours, or Rainbow Reach Bridge (50km) in 10 hours will be withdrawn from the event at those points by the Organising Committee. Note that you should expect to have passed Rocky Point within 7.5 hours to avoid withdrawal at Moturau. Competitors not completing the course within 12hrs will be deemed not to have finished the event.
  11. It is the responsibility of each participant to ensure that their number is visible ON THEIR FRONT and recorded at all checkpoints. Failure to do this will lead to exclusion from the results.
  12. The dropping of litter on the track during the event is prohibited and may lead to disqualification
  13. Competitors must keep to the marked track at all times and may not cut corners. Failure to comply with this requirement may lead to disqualification.
  14. An accepted entry is not transferable to any other runner.
  15. No refunds for withdrawals will be made after 14 days prior to race day. Other conditions apply to earlier withdrawals.
  16. All runners must check-in by 6.30pm the evening before the race and again the following morning at the start line. The Organising Committee reserve the right to give a runner's place to entrants on the waitlist should either of these be missed.
  17. Under no circumstances will the Organising Committee, its sponsors, or any party associated with the event including their employees or agents, have any responsibility or be liable in contract, tort or otherwise, to compensate any competitor or any other party that is directly or indirectly associated with that competitor, for any loss, (including financial loss), injury, damage or death arising directly or indirectly from:
    (a) their intended or actual participation in the event and its related activities;
    (b) any act, omission, error or delay (whether negligent or otherwise) of the Organising Committee, sponsors or any party associated with the event or its employees or agents.
  18. Competitors authorise their name, voice or picture, or any information given on their entry to be used without payment in any broadcast, telecast, advertising, promotion or in any other way relating to this event pursuant to the Privacy Act 1993.
  19. Competitors agree to abide by the rules of the race, to wear a sponsor's bib throughout the event and to allow the sponsors to use photographs taken during the event to advertise their products or to promote the event, at no cost to the sponsors.
  20. Where a runner becomes eligible for two prizes, the prize of greater value is awarded.
  21. By agreeing to the Event Conditions of Entry, you are bound to all matters relating to the event and that any decisions the committee make will be final.

FreshChoice Kepler Challenge

In addition to the General Conditions above, the following apply to this event:

  1. Owing to the environmental and safety considerations, the field is limited to 450 competitors. Although the Organising Committee reserves the right of acceptance, places will be allocated from eligible entries in the order received. Unsuccessful entrants will be placed on a waiting list - also in the order received. Runners will be invited from this list as space becomes available. Payment must be made within 10 days to secure any place from initial registration or as specified in any later invitation email.
  2. Entries will not be accepted from people under 18 years of age on the day of the event.
  3. In the event of extreme weather conditions or other factors beyond the control of the Organising Committee, the Organising Committee reserves the right to substitute an alternative run of a similar distance. In this case, entry fees will not be refunded. If the event is cancelled entirely, the Organising Committee will make the maximum refund possible to competitors.

FreshChoice Luxmore Grunt

In addition to the General Conditions above the following apply to this event:

  1. Owing to environmental and safety considerations, the field is limited to 200 competitors.
  2. Although the Organising Committee reserves the right of acceptance, places will be allocated from eligible entries in the order received. Unsuccessful entrants will be placed on a waiting list - also in the order received. Runners will be invited from this list as space becomes available. Payment must be made within 10 days to secure any place from initial registration or as specified in any later invitation email.
  3. Entries will not be accepted from people under 16 years of age on the day of the event.
  4. In the event of extreme weather conditions or other factors beyond the control of the Organising Committee, the Organising Committee reserves the right to substitute an alternative run of a similar distance. In this case, entry fees will not be refunded. If the event is cancelled entirely, the Organising Committee will make the maximum refund possible to competitors.

Charity Challenge

For runners wishing to enter via the Charity Challenge, the following shall apply in addition to the above conditions.

  1. Charity Challenge places are available to individuals who contact the Organising Committee before the cutoff date as displayed on the website.
  2. In the event that there are more subscribers than places, entrants are taken on a first-come first-served basis
  3. The fee for a Charity Challenge place is deemed a donation to the charity or charities as chosen by the Organising Committee for each year's event. As such it is non-refundable.
  4. The Organising Committee's decision shall be final.

Prize policy

  1. Runners who become eligible for more than one event prize will receive the prize of greater value. The prize of lesser value will be awarded to the next eligible runner.
  2. A competitor is deemed to be a local if they are currently living and/or working in the Te Anau Area for the season during which they run the race. Students whose normal permanent address is within the Te Anau Area may also qualify. The Area includes Manapouri, Milford Sound, and extends as far south as Blackmount and east to Gorge Hill.

Payment

  1. Payment for entries should be made online using VISA or Mastercard through the entries website checkout process. Please contact the Race Secretary should you require an alternative method.
  2. The Kepler Challenge payment and entry system involves an immediate exchange of information between the Kepler Challenge and your bank/card issuer via Payment Express. Your payment is not deemed to be made until it is received by the Kepler Challenge and you receive confirmation from Kepler Challenge of your order by email.
  3. In the case of billing errors, the Kepler Challenge reserves the right to re-invoice with the correct pricing. (You will have the option to request a full refund if this occurs).
  4. Occasionally, your bank may not authorise a transaction, based on your account status or your card not being enabled for online purchases. In these instances, it is your bank denying your card, not the Kepler Challenge so please contact your bank for a resolution.
  5. All prices referred to on this website are based in New Zealand dollars and include 15% GST (Goods & Services Tax). Only the New Zealand Dollar (NZ$) prices on this site are accurate.
  6. All refunds as laid out in the Refunds and withdrawals will be processed in New Zealand Dollars (NZ$) and will not take into account any currency fluctuations or bank charges you may incur.
  7. Merchandise will be available for collection during race weekend check-in, or as agreed with the Kepler Challenge.
  8. The Kepler Challenge Mountain Run Trust is a New Zealand registered charity CC36502.

Collection and use of information

  1. Your information, whether public or private, will not be sold, exchanged, transferred, or given to any other company for any reason whatsoever, without your consent, other than for the express purpose of delivering the purchased product or service requested by the customer.
  2. The email address you provide for order processing, may be used to send you information and updates pertaining to your entry and information about future Kepler Challenge Mountain Run events.
  3. The Kepler Challenge Mountain Run Trust does not sell, trade, or otherwise transfer to outside parties your personally identifiable information. This does not include trusted third parties who assist us in operating our website, conduction of our business, or servicing you, so long as those parties agree to keep this information confidential.
  4. The Kepler Challenge Mountain Run Trust may also release your information when it believes release is appropriate to comply with the law, enforce this site's policies, or protect The Kepler Challenge Mountain Run Trust or others rights, property, or safety.

Complaints or any other comments

  1. Any complaints regarding the event will be directed to and dealt with by the Kepler Challenge Committee at info@keplerchallenge.co.nz

Website Information and Access

  1. The Kepler Challenge reserves the right, at any time, at its discretion, to suspend access to the Website. The Kepler Challenge shall not be obliged to give any reason for such suspension.
  2. The Kepler Challenge reserves the right, at any time, at its discretion, to remove or edit any information entered on the Website that it considers to be unsuitable, misleading, out of date, inappropriate, contrary to any law or not optimised for search engine results.

Governing law

  1. This agreements’ terms of use and the provision of goods and service by the Kepler Challenge are governed by and to be interpreted in accordance with the laws in force in New Zealand and in the event of any dispute arising in relation to these terms of use or their subject matter you irrevocably and unconditionally submit to the non-exclusive jurisdiction of the courts of New Zealand over such dispute.
  2. In the event that any liability is attributed to the Kepler Challenge, such liability is limited to the price paid by you to the Kepler Challenge for the activity purchased on this website.
  3. If any provision of the Terms & Conditions of this agreement are found to be invalid or unenforceable by a court of law, such invalidity or unenforceability will not affect the remainder of the Terms & Conditions which will continue in full force and effect.
